KUALA LUMPUR, Sept 28, 2015:
Army pathologist Colonel Dr. R. Kunaseegaran was charged before the Kuala Lumpur Magistrate’s Court this morning for abetting the murder of deputy public prosecutor Anthony Kevin Morais, whose remains were found in a concrete-filled drum.
Kunaseegaran was charged under Section 109 of the Penal Code, read together with Section 302 of the same act.
Meanwhile, six others — G. Gunasekaran, 47, R. Dinishwaran, 23, A.K. Thinesh Kumar, 22, M. Vishwanath, 25, student S. Nimalan, 22, and debt collector S. Ravi Chandaran, 44 — are suspected to have murdered Kevin on Sept 4 between 7am and 8pm from Jalan Dutamas Raya to Jalan USJ 1/6D.
They face a mandatory death sentence if convicted under Section 302, read together with Section 34 of the same act.
The charges were read to all the accused in Bahasa Malaysia and they nodded to indicate their understanding.
All the accused appeared emotionless except Nimalan, who had his head hung low during the court proceedings.
Kevin’s brother, Richard, appeared angry and heaved while the charges were read out to the accused.
No plea was recorded as deputy public prosecutors Datuk Abdul Razak Musa, Manoj Kurup and Mohd Dusuki Mokhtar asked for another date pending submission of medical reports and other relevant documents.
Kunaseegaran was represented by Datuk N. Sivanathan and Datuk Geetha Ram Vincent, while lawyer M. Manogaran appeared for Dinishwaran.
The five other accused were unrepresented and lawyer Americk Sidhu held a watching brief for Kevin’s family.
Magistrate Siti Radziah Kamardin fixed Nov 30 for re-mention.
When approached after the court adjourned, Richard declined to speak to the reporters.
The body of Kevin, 55, was found in a drum filled with concrete at Persiaran Subang Mewah, Subang Jaya, on Sept 16.
He was reported missing on Sept 4 and was last seen leaving his condominium in Menara Duta, heading to his office in Putrajaya in a Proton Perdana bearing registration number WA6264Q.
Investigators said Kevin was abducted after a staged fender-bender along Persiaran Duta, about 2km from his Menara Duta apartment.
He had allegedly alighted to inspect the damage to his car, when occupants of the other vehicle bundled him into their large pickup truck.
